Jack Responsible For Tractor-Trailer Collapse Which Killed 22-Year-Old Worker

By Randy Appleton,  VA/NC Wrongful Death Attorney

What Happened:

Tragically, a 22-year-old mechanic from Lexington, North Carolina died late last week when a tractor-trailer at the truck repair firm he was working collapsed on top of him. The Director of Davidson County Emergency Services reported that the deadly accident occurred at 5:49 p.m. at the Thomasville, NC headquarters of JRJ Trucking. Emergency services responded soon after a 911 call came in from one of the man’s coworkers who was nearby when the semi collapsed. Investigators say a jack gave way and caused the tractor-trailer to fall, trapping the employee. The Davidson County Chief Medical Examiner said the worker was pronounced dead at the scene when EMTs arrived.

A spokesperson from the North Carolina Department of Labor said the agency would launch an investigation into what happened that may have caused the accident. They will be looking to see if any violations of state occupational safety law played a part in the collapse of the jack. They will also be checking to see if the jack that was used met the specifications required for the task. The agency said it would take three or four months to complete its investigation.

The North Carolina Wrongful Death Attorney’s Perspective:

Thousands of people die in workplace accidents each year, in fact, in North Carolina, “crush accidents”, like the one in this case, are the second leading cause of all workplace fatalities. More needs to be done by employers across the state to protect workers from such easily prevented harm.

If someone you love has been seriously injured or died as a result of workplace accident, it’s essential that you take a moment and reach out to a skilled North Carolina wrongful death attorney. My firm has experience handling such delicate cases and can help guide you through the difficult and confusing process.

Potentially Helpful Information:

The experienced wrongful death attorneys at my firm have successfully represented both workers and the families of workers who have either been seriously wounded or killed while on the job. Massive 95 Car Pileup On I-77 Leaves Three Dead And 25 Injured

By Jim LewisVirginia (VA) Wrongful Death Attorney

What Happened:

A terrible pileup took place yesterday on Interstate 77 near the Virginia-North Carolina border that involved almost 100 different vehicles and left three people dead.

The series of accidents took place on an especially foggy section of I-77 and involved 95 vehicles colliding in 17 separate crashes within a one-mile section of the interstate. The accidents took place near the base of Fancy Gap Mountain in Galax, Virginia and the first ones happened a little after 1 p.m. Sunday.

Virginia State Police say that the accidents resulted in three people dying and 25 others seriously injured.

Tragically, wrecks like this are not unheard of. Since 1997, there have been at least six similar pileups on the same mountain; however, the most recent crash was the deadliest to have occurred thus far.

Though warnings on electronic message boards had been in place since early that morning about the dense fog, it appears drivers did not heed the warning to slow down. In fact, Virginia State Police say that it appears that the crashes were caused by drivers going far too fast for the conditions.

The Virginia Accident Attorney’s Perspective:

Our hearts go out to the families of those who lost loved ones in the recent pileup. Losing someone you love unexpectedly can come as a terrible shock and is difficult to cope with given how senseless the death was. It’s especially frustrating that the Virginia State Police say they believe many of the wrecks were caused by speeding drivers. Going too fast for the conditions is incredibly dangerous, especially in cases with fog and reduced visibility. Being alert, avoiding unnecessary distractions and remembering the rules of the road will help keep everyone safer on Virginia highways.

Helpful Info:

If you were seriously injured in a terrible Virginia car, motorcycle or truck wreck caused by a speeding or otherwise negligent driver, it’s critical that you reach out to an experienced attorney who has successfully handled similar cases. The attorneys at my firm recently recovered nearly $70,000 for one of our clients, a student at a university in Norfolk, VA, who suffered serious injuries after being hit by a distracted driver.

Driver Charged in Fatal Chesterfield V.A. Crash

By James Lewis, Wrongful Death Lawyer

What happened:

A 73 year-old Midlothian, Va. man is dead after the 2003 Infiniti he was driving was slammed into by a 2002 GMC SUV being driven by a man who was trying to elude police.

The 23 year-old driver of the GMC was ordered by police to stop and pull over for an equipment violation on southbound Route 76, Powhite Parkway at the toll booth prior to the Route 60 Exit to Midlothian Turnpike in Chesterfield County. The driver ignored troopers and instead sped off at a high rate of speed.

The GMC sideswiped two vehicles and struck the Infiniti near the intersection of Route 60 and Moorefield Park Drive. The suspect then took off on foot and attempted to carjack another vehicle, but was not successful as the driver was able to drive away. Police caught up with the defendant a short time later and he was arrested.

The driver of the Infiniti and a passenger were transported to the hospital suffering serious injuries, but the driver later died from his injuries.

The suspect driver has been charged with charged with felony and misdemeanor eluding police, obstruction of justice, attempted carjacking; two counts of maiming of another while driving under the influence, felony hit and run; two counts of misdemeanor hit and run; driving under the influence, refusal to submit to a blood or breath test, driving while suspended, disregarding a traffic light, defective equipment, and failure to wear his safety belt. Additional charges are pending.

The Virginia Lawyer’s Perspective:

The decision to speed off instead of obeying the state troopers command to pull over has had tragic consequences in this case. One family grieves the loss of their loved one. And another victim is seriously hurt, with a possible long road to recovery.

Although the suspect driver in this case is facing many serious charges, the victims should contact a Virginia personal injury attorney to find out what civil damages they may be entitled to. Our law firm offers a guide that answers questions for people who become victims resulting from crashes where a police chase was occurring.

Charlotte Woman Charged After Killing Another Driver In Head-On Collision

By Kevin DuffanVA/NC Wrongful Death Attorney

What Happened:

Police from Charlotte, NC arrested the driver of an SUV who was involved in a fatal accident last week on Mallard Creek Road. The woman, Lasonya Denise Thompson, 38, was charged with misdemeanor death by vehicle after hitting another car head-on.

The police have said that Thompson crossed the centerline in her Nissan Armada SUV while driving down Mallard Creek Road and struck the other driver’s Saturn ION head-on. Police don’t yet know what caused Thompson to cross the center lane.

Witnesses have told police that both vehicles ended up going airborne, flipping over several times before landing upside down. The driver of the Saturn, 39-year-old Zaida Esther Concepcion and two other passengers of her vehicle had to be cut out of the car by emergency responders. Police say the extraction took 27 minutes.

Tragically, by the time Concepcion was removed from the car and taken to Carolinas Medical Center it was too late and she was pronounced dead. Two of the other passengers in the vehicle were airlifted to CMC with life-threatening injuries.

Thompson has been charged not only with misdemeanor death by vehicle, but also with driving with no liability insurance. She remains in jail at this point on $10,500 bond.

The North Carolina Wrongful Death Attorney’s Perspective:

We extend our sympathy to the family of the woman who died. Losing a loved one is always hard, but especially so when the accident comes out of the blue. Police don’t yet know what caused the driver to drift out of her lane, hopefully something as preventable as distracted driving was not to blame for the deadly crash.

The family of the victim in this tragic case should contact an experienced NC wrongful death attorney to ensure that the driver is held accountable. Even though criminal charges are being pursued against the driver, it’s important to understand that a civil claim for compensation can still proceed regardless of what prosecutors decide to do.

Potentially Helpful Information:

If you’re considering reaching out to an attorney, make sure it’s someone who has experience handling such difficult and emotionally trying cases. My firm handled one case where our client was killed by the driver of a tractor-trailer, leaving his wife and four children behind. In that case, we were able to secure a $2.4 million settlement for the family. Though the money does not help to heal the deep wounds left after the man’s death, it helps provide some much needed money to a family in need.

If someone you love died due to the reckless or negligent behavior of someone else, you’re likely confused about how to begin the process of holding the at-fault party accountable for his or her actions. Wrongful death actions can be confusing and are often unfamiliar to most people who, thankfully, have little experience with such lawsuits. For more information on the process, read through my firm’s guide on the wrongful death claims process in North Carolina.
